Pilates Preps Me For Court Date

March 14, 2010 by Mernahuana divider image

Last court appearance where nothing happens.

Has it been four weeks already? Must be since my February court appearance. How do I know? I’m back in court, Monday March 15, to fight for your right to grow medicinal marijuana.
After twenty-three months of monthly court appearances I’m getting well known amongst court staff, judges and Niagara Regional Police Service cops, who perform courthouse searches. The last cop who courthouse searched me commented I have a very good case.
It’s true. It’s true. ultra-skunkweb12
The defense is an extensive challenge devised by Toronto lawyer Paul Lewin with research assistance by myself. Code name Rural vs. Urban. We have a small mountain of evidence to present defending my choice to grow medicinal marijuana.
Instead of buying marijuana on the underground market.
My only other option would be to rely on the underground market (note I don’t use the words black market as it is a reference to slaves being sold) to obtain my medicinal marijuana. The feds are claiming they didn’t violate my right to possess medicinal marijuana (R v. Parker). They charged me with one count personal production because there’s no case law supporting someone’s right to grow medicinal marijuana.
It’s clearly obvious by documents released by Health Canada efforts are underway to ramp down licensed legal marijuana growing. Potentially eliminating the option all together. Doctors who prescribe over five grams are sent an information letter. Though they can prescribe up to 10 grams a day.
Yet the government agency does nothing to promote the Medicinal Marijuana Access Division. Though the federal anti-drug message is more noticeable than ever. No money has ever been spent informing doctors or Canadians about medicinal marijuana.
champagne-007 No Health Canada rep, like the pharmaceutical reps, goes around to family practitioners informing them about the benefits of med bud.
There’s plenty of pressure from law enforcement agencies to do away with grow your own.
Making R v. Mernagh an important push back.
The feds would have to respond when someone wins the right to grow marijuana.
Just like they did in Parker.
So what is going to happen on Monday March 15?
Nothing.
We’re setting a date for Apr. 19. At which time the feds have promised to set some trial dates. Both Lewin and myself wanted a slow summer trial lasting three to seven weeks. A public mockery of our marijuana laws.
It’s looking like it’ll be late fall or winter.
Unless the court schedule remains remarkably open.
The feds have been making constant concessions to speed up the trial process.  Along with preventing terminally and chronically ill from testifying publicly in St. Catharines. We’re reaching an agreement where a letter of diagnosis from your doctor and a sworn statement looks to be all we will need.
On Apr. 20 I’m holding a press conference to announce the trial dates.
Then celebrating with all my friends at Yonge and Dundas Square with a smoke-out. Though for bail purposes I won’t be possessing marijuana.
So someone will have to hold joints and bongs for me while I inhale from them.
This will officially announce our charter challenge to the marijuana laws.
Notification was provided to the courts months ago.
A two year holding pattern (I could have pleaded guilty done the sentence and returned to growing) is exceeding stressful.
shishkaberry-8 Thankfully my personal pilates instruction has been paying off wonderfully. I’m breathing much better. For several days after my pain levels are lowered. I feel better about myself. Confident.
The breathing during pilates opens my body up so much I get a little tingly body buzz. Having a pilates instructor who is not only encouraging, but also very, very, hands on has been a blessing.
